James married Giles ROSS, daughter of Sir John ROSS Lord Ross of Halkhead, Sheriff of Linlithgow and Marjory MURE of Caldwell, May 1480(contract).1 (Giles ROSS was born about 1455.)

Apud REX ad instantiam partium secundum tenorem Acti Pari fecit registrari literam obligationis, sub hac forma ; - Be it kend, &c me Gelis the Ros the douchter of Schir Johnne the Ross of Halkhed, Knicht, to be bunden and oblist . . til SCHYR JOHNNE AUCHINLEK of that ilk, knycht, and to his airis, that I sail resigne and be thir present lettres resignes and overgefis thair landis quhilk I am in undirwrittin,[....] that quhat time and how sone the mariage beis maid lauchfull betuix James Auchinlek, sone and apperand are to the said Schyr Johne, and me the said Gelis, than I resigne all the fornemit landis ; - and gife it happenis me to part with the said James or the dispensatione cum hame in my default than elekewise I resigne . . the said landis ... or gife it sail happin me, eftir the dispensatioun cum hame to part with the said James and will nocht marry him agane eftir the tenour of the said dispensatioun, than I resignis the said landis .... In witnes, &c. ... I have set to my sele at Halkhed, 3 Mar., 1480.

"Glenbervie is a barony in the Mearns. It was in possession of the Melvils as early as the time of Alexander II., and continued in that family until 1468, when it ended in Elizabeth, daughter, and at last sole heiress of the last baron. She was married to Sir John Auchinleck of that ilk, and bore him a son and heir, James. He married Giles, a daughter of Sir John Ross of Halkhead, Knight, and left a daughter, Elizabeth, sole heiress. Her ward and marriage falling to King James IV., he assigned it to Sir William Douglas of Braidwood, Knight, son of Archibald, fifth Earl of Angus, in 1492, where-upon there happened a contest between the said lady and James Auchinleck of that ilk, her cousin German, regarding tlic right of succession. After long disputing the matter was referred by both parties to certain noblemen, who determined the barony of Glenbervie to the said Elizabeth and Sir William Douglas, her husband, whereupon he took the coat of Auchinleck, viz. : - Argent, a cross imbattled, sable, into his achievement."

"James Auchinleck, younger of that Ilk, who is styled son and heir to Sir John Auchinleck and Elizabeth Melville in a charter by William Cumming of Culter dated 29 April 1476. He m. Gelis, daughter of Sir John de Ross of Halkhead, (c/m 8 May 14801[1 Douglas Charters. No. 110]), who resigned various lands to his father Sir John de Auchinleck, in implementation of their marriage on 3 May 1480.2[2 RMS 1424-1513 No. 1483 & 1484] He pre-deceased his father, dying before 1501, and having had issue"
