  General Notes:

"The Maitlands retained some hold on the lands of Schives, for they received a charter of infeftment from the king on July 6, 1672 (Acts of Parliament). On August 3, 1674, Sir Richard Maitland of Pitrichie, one of the Senators of the College of Justice, and his son, Sir Richard (as noted in the Records of Aboyne, p. 337), entered into a contract with Charles, Earl of Aboyne, whereby they sold to him the lands and barony of Gight, or Schivas, and, in terms of that contract, they resigned the lands. Thereupon Charles II. granted a charter under the Great Seal of the lands and barony of Gight in favour of the Earl of Aboyne, dated Edinburgh, August 4, 1675. On May 31, 1678, Sir Richard (the second) was served heir to his father, the Senator, in (among other places) the shady third part of Newton of Schivas, with the pertinents called Skillmanee, which lands were held 'immediately in chief of Sir George Gordon of Gight and Robert Irvine of Fedderet, or either of them ... in feu farm and heritage for yearly payment of 40 shillings Scots at two terms in the year'. He also held the double part of the towns and lands of Auchincrive from the same owners (Antiq. Aberdeen and Banff, iii., 76). On January 28, 1681, Charles Maitland was served heir to his brother, Sir Richard, in the lands and barony of Gight, with the tower, fort, manor place and tithes, which were all held in chief of the king in free barony and heritage perpetually (Ibid., iii., 559)."

Richard married Katherine LUMSDEN, daughter of Reverend Mr Thomas LUMSDEN Minister of Kinkell parish and Elizabeth STEWART, on 9 March 1630 in (Contract).1 2 (Katherine LUMSDEN was born about 1595.)


  Marriage Notes:

"Patrick Gordon died before 1630 .... After his death, she (Katherine Lumsden) married Mr Richard Maitland of Auchencruive, her marriage contract with whom was signed at Nethermuir, March 9, 1630. Some money which Mrs Maitland possessed at the date of the contract was to be invested at the sight of George Gordon of Nethermuir, and Mr William Lumsden, advocate in Aberdeen, both of whom, together with John Gordon, a brother of the former, were witnesses to the signing of the deed. She was again a widow by Feb. 26, 1643, on which date she brought an action against Richard Maitland of Auchencruive, son and heir of the said Richard (Littlejohn's Aberdeenshire Sheriff Court, iii., 19)."

Registration Katherine Lumisden, widow of Mr Richard Maitland of Auchincreiwe v Richard Maitland of Auchincreiwe, son and heir of the said Mr Richard Maitland. The deed, which was ordained to be registered, was the marriage contract between the deceased Mr Richard Maitland and the Pursuer, by which there was settled on her, the liferent of Milne of Cairnfechill, in the parish of Udny. The pursuer had been previously married to Patrick Gordoun of Neithermuire, at which place the Contract had been signed on 9 March 1630. Some money which Mrs Maitland possessed at the date of the Contract was to be invested at the sight of George Gordoun of Neithermuire, and Mr Wm. Lumisden, Advocat in Abd. both of whom, together with John Gordoun, a brother of the former, were witnesses to the signing of the Deed."
