Thomas was the second son of James Burnet of Craigmyle. He purchased the manor house at Kemnay in 1688.



"Sir George Nicolson bought Kemnay, in 1682, from Alexander Strachan, younger of Glenkindie. He was the son of an Aberdeen merchant; and was called to the Scottish Bar in 1661. He succeeded Dr. Arthur Johnston's son, 'William, as Civilist in King's College, Aberdeen, at which time, and into 1861, he was styled "of Cluny '. He was made a Judge of Session in 1682, taking the title of Lord Kemnay, from his newly acquired property. He sold Kemnay, in 1688, to Thomas Burnett, ancestorof the present proprietor."

Thomas married someone Margaret PEARSONE, daughter of John PEARSONE Merchant in Edinburgh and Eupham BAXTER, in November 1655.1 (Margaret PEARSONE was baptised on 17 December 1640 in Edinburgh parish, Edinburgh, Scotland and was buried on 16 November 1688 in Kemnay, Aberdeenshire, Scotland 1.)
