"Alexander in time became portioner of one sixth part of Innermeath and laird of a one third portion of Laithers and was designed Alexander Garden of Dorlaithers.
At Aberdeen on 14 Nov 1533, Alexander Garden portioner of Laithers agreed an excambion of lands with John Dempster of Auchterless-Dempster. John granted to Alexander one sixth part of his domicile lands of Laithers, Durlathers , Glasslaw and Woodhead with a sixth part of the multures and mill lands thereof in the barony of Auchterless-Dempster in exchange for Alexander's lands of one sixth part of Muiresk, Fortrie, Ardmiddle, Rochtlocht and Kynnarmyte, with a sixth part of the multures therof in the barony of Laithers.
Patrick Chene of Esselmont brought a complaint to the Crown in 1542 that on the 13th, 14th and 15th April Mr. James Berclay of Kinharrachy, with his servants and accomplices to the number of 40 persons, armed for war, broke down a great part of his fishing cruive wall and also diverted the Water of Ythan by the old channel and passage from the cruives, cruive wall etc., and robbed him of his possession thereof and refuses to pay the damages incurred amounting to £20 Scots. He raised the complaint in Edinburgh as he suspected he would not get a fair hearing from the Sheriff of Aberdeen whose deputies were kinsmen of Mr James. To address this matter George earl of Huntly issued from Huntly a Certificate that the mair depute of the sheriffdom of Aberdeen , charge Patrick Chene and Mr James Berclay to compear in a sheriff court to be held at the cruif wall of Ellon on 20th May 1542 for cognition of the above matters. In addition that on 8th, 9th, 10th, 11th and 19th May James Berclay charged a number of men to appear on the said day and place, upon said inquest under penalty of £20 for each person. Robert Stewart of Lathers and Alexander Garden of Durlathers were among those charged.
Alexander died about mid 1545 and was succeeded by his son George who paid the Exchequer in May 1546 £13 6s 8d for relief of two terms of non-entry of lands of the barony of Invermeith (Perthshire). "
