COURT CASE
On 8 December 1702 at the Court of Session the case of John Watt against David Forrest was heard. The case centred on a deed drawn up for Mr Robert Lauder of Gunsgreen, containing a clause which stated that if all of his children died, without heirs of their bodies, he oblige himself to pay a certain sum to his wife.
The sum was 5000 merks, the same amount Robert Lauder had received from her father when he married Anna Congalton. This sum of money had been assigned by the widow to John Watt and he in turn pursued David Forrest, a son in law of Robert Lauder for the amount. Forrest was an heir portioner of Robert Lauder and of his son Major Lauder. By the time of the court case their were no 'heirs of their bodies' for Robert Lauder's children had died. However, Margaret, one of Robert's daughters, had had a son, who had never been served heir, and had predeceased his uncle, Major Lauder. It could not be maintained that Robert Lauder's children had had no heirs, therefore the wife's case was void. She had no claim. 6 7
Anne married Robert LAUDER younger, of Gunsgreen, son of Robert LAUDER elder, of Gunsgreen, Bailie of Tyninghame and Elizabeth CRAW, 12 March 1636(contract).1 (Robert LAUDER younger, of Gunsgreen was born about 1620.)

"The testament dative and inventory of the goods, property, sums of money, and debts belonging to the deceased Robert Lauder of Gunsgreen at the time of his death, who passed away in the month of [blank] in the year of God 16[blank].
Faithfully made and given up by Francis Hepburn of Beanston, who is decreed as the sole executor-dative as a creditor to him, insofar as by a marriage contract made at Congalton on the 12th day of March 1636 between the said deceased Robert Lauder (acting for himself and taking responsibility for his son, Mr Robert Lauder) on the one part, and the deceased William Congalton of that Ilk (acting for himself and taking responsibility for his lawful daughter, Anna Congalton) on the other part. By virtue of this contract, and for the marriage then agreed upon and thereafter solemnised between the said parties, the said deceased Robert Lauder bound and obligated himself, his heirs, executors, and successors, to properly and sufficiently transfer ownership and grant possession, by charter and sasine, to his son, the said Mr Robert Lauder, and the heirs lawfully to be fathered between him and the said Anna Congalton[....]
And furthermore, the said deceased Robert bound and obligated himself and his foresaids to have in readiness, employ, and invest upon sufficient land and annual interest at the feast and term of Martinmas then next following in the said year of God 1636, the sum of 10,000 merks in money of this realm of Scotland, along with the sum of 5,000 merks of the aforesaid money given in the name of a dowry, extending in total to 15,000 merks, for the benefit of and for ownership to be given thereof to the said Mr Robert Lauder and his said spouse and their foresaids, at the sight and by the advice of the said deceased William Congalton, and failing him by death, Patrick Congalton, his eldest lawful son and apparent heir."

Anne next married Right Reverend Mr Patrick SCOUGAL Bishop of Aberdeen on 6 January 1660.2 (Right Reverend Mr Patrick SCOUGAL Bishop of Aberdeen was born in 1607, died on 16 February 1682 and was buried in 1682 in St Machar Cathedral, Aberdeen, Scotland 2.). The cause of his death was asthma.

"Following his first wife's death, on 6 January 1660 he (Patrick Scougal) married Anne Congalton (d. 1696) .... Scougal died of asthma on 16 February 1682 in Aberdeen and was buried in his cathedral. His wife, who survived him by nearly fifteen years, subsequently remarried and became Lady Gunsgreen."
