"John (Hepburn). John de Hibburne had a charter of donation dated 9 June 1363, granted by Patrick of Dunbar, Earl of March and Moray (who styles him his alumnus),of the lands of Over and Nether Merkill, to him and the heirs-male of his body, whom failing to Patrick Hibburne his brother and the heirs of his body; Nisbet identifies the latter with Sir Patrick de Hebburne (of Hailes) who witnessed a charter of which the royal confirmation is dated 23 February 1368-69."
