  General Notes:

SIR WALTER, taken prisoner at the battle of Durham 1346, was imprisoned in the Tower, Windsor, and Odyham Castle. On 15 May 1350 he swore not to bear arms against Edward in. till the Candlemas following, and then to surrender himself prisoner again. He continued a prisoner, though more than once liberated temporarily on parole, till he was released along with King David II. in 1357. He became one of the King's Council, was High Sheriff of Berwick 1364, and one of the Scottish Ambassadors for a treaty of peace with England 1367 ; did homage to Robert II., and sealed the Act of Settlement 1371, and his name is also mentioned as a consenting party to the Act of Settlement in 1373. He witnessed, as Sir Walter de Haliburton dominus ejusdem, with Sir John and Sir Alexander de Haliburton, probably his brothers, a charter by George, Earl of March, to John Sinclair of Herdmanstoun, 12 June 1372. He was also witness to a charter by Margaret Stewart, Countess of Mar, 2 January 1378-79." (pages 332-333)

"p. 333, 1. 9, for ' 1372 ' read ' 1377.'
p. 333, 1. 11, after '1378-79,' insert 'He was alive 1388 (see below), and had a son John, his successor, and a daughter Jean, married to Henry St. Clair, first Earl of Orkney of the St. Clair line ; in the charter of 1388 quoted below, Henry, Earl of Orkney is styled brother of Sir John Haliburton, which proves that Jean in the text is placed a generation too low.' " (page 102)

Note: In the above extract from Scots Peerage, volume 4, the author must be mistaken where Sir John is concerned, when he says

"He witnessed, as Sir Walter de Haliburton dominus ejusdem, with Sir John and Sir Alexander de Haliburton, probably his brothers, a charter by George, Earl of March, to John Sinclair of Herdmanstoun, 12 June 1372 "

since he has just told us, on the previous page, that Sir Walter's brother, Sir John Haliburton, died in battle in 1355. 1 2
