Janet married Sir Adam HEPBURN of Hailes, son of Sir Patrick HEPBURN younger, of Hailes, 'Miles magnanimus et athleta bellicosus' and Younger daughter VAUX co-heiress of Dirleton, About 2 November 1411(papal dispensation).1 2 (Sir Adam HEPBURN of Hailes was born about 1378.)

  Marriage Notes:

"Janet, married, first, as his second wife, to James Douglas, Lord of Dalkeith (whose first wife was tlie Princess Elizabeth, third daughter of Robert III.), and, secondly, to George Crichton, Earl of Caithness." (page 96)

from Scots Peerage (vol 2)

Referring to the Borthwick article in The Scots Peerage, volume two, though not to the above quotation, volume 9 states:

"p. 95, 1. 20, after ' him ' add note, ' On 1 May 1411 a dispensation was issued for the marriage of William Borthwick and Beatrice Sinclair, but there is no clue as to which William Borthwick is meant (Reg. Aven., 337, BORTHWICK 39 f. 170). He had a daughter, Janet Borthwick, for whose marriage to Adam Hepburn, lord of Hailes, a Papal dispensation was granted on 2 November 1411 (Reg. Aven., 339, f. 549).' " (pages 38 and 39) from Scots Peerage (vol 9 Addenda et Corrigenda)

Note:

Only the second part, underlined by this researcher, of this correction makes any sense chronologically. Otherwise it is misleading. The marriage in question is probably that of a later William Borthwick.

Janet next married Sir James DOUGLAS 2nd of Dalkeith, son of Sir James DOUGLAS Lord of Dalkeith and Agnes DUNBAR, before 1439.1 3 (Sir James DOUGLAS 2nd of Dalkeith was born about 1373 and died by May 1441 3.)

  Marriage Notes:

"Janet, married, first (see note below), as his second wife, to James Douglas, Lord of Dalkeith (whose first wife was the Princess Elizabeth, third daughter of Robert III.), and, secondly (see note below), to George Crichton, Earl of Caithness." (page 96) "In Parliament, 14 March 1457-58, the Chancellor, addressing himself to James, third Lord Dalkeith, who was about to marry the Princess Joan, sister of James I., stated that the King purposed to create him Earl of Morton, whereupon Lord Borthwick, on behalf of his sister Lady Dalkeith, represented that the lands of Morton heritably belonged to her and her son, and prayed that the King might do nothing to the prejudice of their rights. In answer the Chancellor explained that Lord Dalkeith was not to receive his title from Morton in Nithsdale, but from Morton in the territory of Caldercleir, of which declaration Lord Borthwick had a formal record preserved." (page 97)

from Scots Peerage (vol 2)

Note:

In
The Scots Peerage, volume 9, Addenda et Corrigenda', Janet Borthwick is noted as having had a papal dispensation in 1411 to marry Adam Hepburn, before her marriage to George Douglas.

"It is not certain when she (Elizabeth Stewart) died, but Sir James (Douglas, 2nd of Dalkeith) married, secondly, before 1439, Janet, eldest daughter of Sir William Borthwick. The marriage could not have taken place till after 2 November 1411, when a papal dispensation was issued for Janet Borthwick's marriage with Adam Hepburn of Hailes. She survived Sir James, and married, secondly, Sir George Crichton, afterwards Earl of Caithness, whom she also survived."
