Eldest son of John Cumine, 2nd of Kininmonth, and Mary Keith, his wife, of the Marischal family. He had three brothers. Married before 1740 the Hon. Sophia, daughter of 15th Lord Forbes, who died aged 75 in 1790. After Culloden he went into hiding, but through his wife's influence he secured a pardon (she was presented to George II and described her husband as 'a fool').
