1642 June 15 Removing. Thomas Forbes, lawful son of the late Patrick Forbes, burgess of Abd., heritable proprietor of the lands, and Thomas Cargill, burgess of Abd., his Tutor, v. Wm. Couttis of Cluny, Wm. Broun in Auld Maynes of Cluny, Robert Wat there, and James Wilsone there. Sasine dated 24 July, 1633. Notary Mr. Robert Reid.
1643 June 9 Rent. Thomas Forbes, lawful son of the late Patrick Forbes, burgess of Abd., heritable proprietor of the lands, and Thomas Cargill his Tutor Dative, for his interest v. Wm. Broun, Robert Watt, and James Robertsone, all in Auld Maynes of Cluny, and Wm. Couttis sometime of Auchtercoull and Janet Gordoun, his wife. The Pursuer was proprietor, apparently by way of wadset, and the Sasine produced was dated 24 July, 1633. Notary Mr. Robert Reid. The Gift of Tutory was dated 19 June, 1637. The rents sued for were for the years 1632 to 1641 inclusive. On 24 December, 1635, Couttis had with consent of Sir Alexr. Gordoun of Cluny ratified the Pursuer's rights, notwithstanding which he had been intromitting with the rents, for all which, in different measure, he and the tenants were found liable.

There were produced (i) Sasine dated 24 July, 1633, Notary Mr. Robert Reid; (2) Gift of Tutory (but no Tutor mentioned), dated 19 June, 1637 ; and (3) A Ratification by Couttis. ( Vide Supra p. 15.) Expenses 4O/- each Defender."
