James was the second son of William, son and heir to Alexander Sutherland of Duffus.
He bought Kinminitie in Banff from James Grant of Freuchie and Blanch in the parish of Rogart in Sutherland together with other lands from John Murray of Aberscors in 1624. He was tutor to his nephew Alexander Sutherland of Duffus. He was ancestor to the Sutherlands of Kinminitie.
In 1670 the lands of Clunemoir in Mortlach parish, Banffshire, were transferred to 'James Sutherland of Kinminnity' by Robert Sanders (or Alexander), son of William Sanders, minister of Bellie.
James married Margaret SEATON, daughter of John SEATON of Monylangain, County Longford and Unknown. (Margaret SEATON was born about 1600.)
