TRIAL VERDICT AND SENTENCE Intran
John Norval, William Renwick, and James Miller
prisoners in the Tolbooth of Glasgow, and Patrick or Peter Quigly and Mary
O’Hara his wife also prisoners there Pannels Indicted and Accused at the
instance of His Majesty’s Advocate for His Majesty’s Interest for the Crime of
Theft and Reset of Theft, in manner mentioned in the Criminal indictment raised
against them thereanent. Bearing that (here record the
libel) The Indictment having been read
over to the Pannels in open Court and they being severally interrogated
thereupon the said John Norval William Renwick and James Miller answered Guilty
and the said Patrick or Peter Quigly and Mary O’Hara answered Not Guilty Pro(curato)rs Pro(curato)rs For the prosecutor For the
Pannels The Advocate Depute Mr Francis
Jeffrey and Mr Robert Thomson Advocate The Lords having considered the
Indictment against the said John Norval, William Renwick, James Miller, Patrick
or Peter Quigly and Mary O’Hara Pannels find the same relevant to infer the
pains of law but allow the Pannels and each of them a proof in exculpation and
alleviation and remit the Pannels with the Indictment as found relevant to the
knowledge of the assize

who were all lawfully sworn and no objections to the
contrary – The said John Norval, William
Renwick and James Miller being again interrogated by the Court in presence of
the Jury whether they were guilty or not guilty of the Crimes charged against
them in the Indictment they all answered Guilty, and the said John Norvall and
William Renwick subscribe this judicial confession of their guilt in presence of
the Court and Jury and the said James Miller authorises his Counsel to subscribe
the same for him in respect he cannot write

The above confession was then read over to the Jury Whereupon the Prosecutor
proceeded to adduce the following witnesses in proof of the Indictment who were
all lawfully sworn and no objections Robert Jamieson one of the
Magistrates of Glasgow Andrew Simson the Clerk to
Richard Henderson one of the Town Clerks of Glasgow Alexander Drummond now or
lately shop man to James Drummond & Co. scotch cloth merchants in Glasgow Neil McLean now or lately
apprentice to the said James Drummond & Co Helen Morrison dressmaker
residing in Little Dow-hill of Glasgow Robert Brown horse dealer in
Glasgow and Master of the horse patrole there James Bain police officer in
Glasgow Agnes Thorburn widow of
Archibald Davidson tanner in Glasgow residing in Little Dow-hill of Glasgow John Smith present prisoner in
the Tolbooth of Glasgow The Declarations of the Pannels
Patrick or Peter Quigly and Mary O’Hara having been passed, were read over in
open Court. Whereupon the Advocate Depute
declared his evidence concluded and the Counsel for the Pannels declared they
had no evidence to adduce in exculpation. The evidence was then summed up
on the part of the Prosecutor by the Advocate Depute on the part of the Pannels
Quigly and O’Hara by Mr Francis Jeffrey advocate and lastly by Lord Gillies the
presiding Judge. The Jury by the mouth of the
said Boyd Alexander their Chancellor find the said John Norval, William Renwick
and James Miller guilty of the different charges of theft libelled and also find
the said Patrick or Peter Quigly and Mary O’hara guilty of the Reset of the
goods stolen from Drummond & Company’s shop as libelled.
The court adjourned. Intran John Norval, William
Renwick, and James Miller, Peter or Patrick Quigly and Mary O’Hara wife of the
said Patrick or Peter Quigly, Pannels Indicted and Accused as in last
sederunt. The diet having been called and
the verdict read over, the Court pronounced the following sentence. Lord Hermand and Lord Gillies
having considered the verdict of assize returned against the Panels at last
sederunt. In respect of the said verdict
decern and adjudge the said John Norval, William
Renwick and James Miller to be carried from the bar to the Bridewell of the City
of Glasgow therein to be detained for the space of twelve months from this date;
and upon the elapse of the said period grants warrant for setting them at
liberty. And further in respect of the
said verdict decern and adjudge the said Patrick or Peter
Quigly and Mary O’Hara Pannels to be transported beyond seas to such time as His
Majesty with advice of His Privy Council shall declare and appoint. And that for
the space of fourteen years from this date: with certification to them that
after being so transported they shall return to or be found at large within any
part of Great Britain and Ireland during the said space of fourteen years
without some lawful cause and be thereof lawfully convicted they shall suffer
death as felons. And that in terms of an/the act passed in the twenty fifth year
of the reign of His Present Majesty for the effectual transportation of felons
and other prisoners in that part of Great Britain called Scotland. And ordain the said Patrick or
Peter Quigly and Mary O’Hara to be carried from the bar back to the Tolbooth of
Glasgow therein to be detained till an opportunity shall offer for their
transportation as said is. For which this shall be to all concerned a sufficient
warrant.
